HR teams and employees usually use these terms as if they were synonymous. They are not. A relieving letter ends the employment relationship, while an experience letter details what the employee achieved during that period. ThePeoplesBoard covers the formats, the legal position in India, and ready-to-adapt templates.

What is a Relieving Letter?

Relieving letter meaning: It is a formal document issued by the HR department of the company on the company letterhead signifying that the company has accepted the resignation and relieved the employee of all his/her duties. It is issued by HR after the end of the notice period, handover and return of the assets; the HR head or any authorised signatory signs it.

The relieving letter shall contain the following details:

  • Name of employee, ID number, designation and department
  • Date of resignation & acceptance of resignation
  • Final Working Day (the day of official release)
  • Confirmation of handover and clearance completed

What is an Experience Letter?

An experience letter, also called an experience certificate or service certificate, indicates the employee’s work record. It has the joining date, end date of employment, designation, and core responsibilities as well. Some employers insert a statement of conduct.

This helps them confirm a role when they do a background verification. New hires also sometimes rely on the letter to apply for visas, get loans, attain higher education and continue benefiting in government service.

Relieving Letter vs Experience Letter: Key Differences

Is relieving letter and experience letter the same? No. The difference between a relieving letter and an experience letter is clearest side by side:

BasisRelieving LetterExperience Letter
PurposeConfirms the exit is formally completeCertifies work done and tenure
TimingAfter notice period and clearanceOn or after the last working day
ContentsLast working day, release from dutiesDates, designation, duties, conduct (optional)

In the case of some companies, it is possible to obtain a relieving cum experience letter. This only works if it includes both details: the release confirmation and role history. But again, a verifier may want two documents and may easily reject the merged document.

Are These Letters Mandatory in India?

No central law requires a document to be called a “relieving letter”; industry guidance treats it as practically essential but not statutory. If so, you should probably look into the service certificate.

The Industrial Employment (Standing Orders) Act, 1946 has been replaced by the Industrial Relations Code, 2020, which went into effect on 21 November 2025. The Model Standing Orders, 2026, effective from 8 May 2026, mandate that the services sector model provide a service certificate within ten days of the employee’s service end on account of discharge, termination, retirement or resignation.

Three limits apply:

  • Standing orders apply to companies with 300 or more workers.
  • JSA observes that coverage of the central model across state-jurisdiction establishments must be determined, on a case-by-case basis.
  • Some state Shops and Establishments rules may impose their own conditions, so check your state for the specifics.

Additionally, the Code on Wages, 2019 means that wages must be paid within two working days of the employee’s resignation or removal. Because company policy and the appointment letter often go beyond what the law stipulates, as broad as the law permits, confirm it in your policy.

When Does a Company Issue These Letters?

A relieving letter will be issued only after the exit is completed, and at or after the employee’s last working day an experience letter is issued. It depends on the type of exit for timing and eligibility. How this works in practice.

The standard timeline for a resignation

  1. Resignation accepted. HR letter confirms acceptance, and a last working day is scheduled as per the notice period in the appointment letter.
  2. Notice period and handover. Employee has to hand over the project responsibilities. Manager should sign off.
  3. Exit clearance. IT, admin, finance and the reporting manager note that assets are returned and that dues are noted. The exit interview will be conducted in this phase.
  4. Last working day. HR issues the relieving letter and the experience letter (or a relieving cum experience letter). Some organisations hand over both on shift day itself.
  5. Within two working days. Final wages are due under the Code on Wages, 2019. Full and final settlement as per organisation policy may come after.
  6. Within ten days (where Model Standing Orders apply). The service certificate has to be done, unless it has already been done.

The practical rule: the clearance must not run past the last working day, so if it does, you will put your all into that; in such cases, the employee will not be able to join the next company on time.

AbscondingNoNot routinelyOnly after due process and a separation letter; take legal advice
Resignation during probationYesYesSame process, shorter notice period

Situations that need extra care

Termination for misconduct: A termination letter is issued to the employee, and no relieving letter is issued. Experience letters are not commonly issued, either. But where standing orders apply, a factual service certificate (tenure and designation, with no misconduct remarks) nevertheless may still be payable. Consult legal before you issue or refuse.

Absconding: An employee who has escaped. Written notice to the employee’s registered address and proof of each attempt to reach them. When due process has been completed, issue a separation letter or termination letter. Since the employee has never been formally released, no relieving letter is provided. Even in cases where standing orders are employed, verify whether a service certificate can be issued.

Pending clearance or recoveries: Take lawful deductions in the last settlement for all dues. Do not hold the documents. Documents cannot be withheld on any claim against the employee that has nothing to do with unpaid wages, leading to a complaint with the labour department.

Common Mistakes HR Should Avoid

  1. Treat the two letters as one. Verifiers verify both, so a missing relieving letter can stop you from joining.
  2. Date mismatches: The final working day must remain consistent across the relieving letter, experience letter and payroll details.
  3. Subjective remarks: We need objective factual evidence to stay in the service record.
  4. Late issue: An inability to issue a service certificate within a 10-day service-certificate window leads to non-compliance.
  5. Using letters as leverage: Holding documents to force a notice-period buyout or recovery invites disputes.
  6. No tracking: An HR audit often finds exit documents missing or discrepancies, and HR automation removes this risk.

Conclusion

A relieving letter and an experience letter answer two different questions. The first tells a new employer, “This person has left cleanly.” The second tells them, “This is what they did here.” An employee usually needs both, and HR should treat them as two separate deliverables in every exit.

For HR teams, getting this right comes down to three things:

  • Issue on time. Aim to hand over both letters on the last working day. Treat the ten-day service certificate deadline as an outer limit, not a target.
  • Keep it factual. Dates, designation and duties. Nothing that can’t be backed up by records.
  • Write it down. A clear exit document policy that covers every type of separation (resignation, retirement, termination, absconding) means every employee is treated the same way, and no manager improvises.

Start with a quick audit of your current templates and your last ten exits. Check whether letters went out on time, whether dates matched payroll, and whether any were held back over recoveries. Fix those gaps now, and exits stop becoming disputes later.

FAQs

What is the difference between a relieving letter and an experience letter in simple words?

A relieving letter is a document confirming that the employer has discharged you and your employment has officially ended. An experience letter is a document of your role, duties and experience. Most new employers always ask for those two letters.

Is relieving letter and experience letter the same?

No, they are not the same. A relieving letter is a legitimate exit, while an experience letter is a record of your experience. The only condition under which a combined relieving cum experience letter is accepted as a single letter is when it includes both sets of details.

Can a new employer refuse to onboard without a relieving letter?

Sure! There is no law mandating a Relieving Letter. Most companies however, verify it as part of the reference check process to confirm the end date of your last employment.

Can an employer refuse to give an experience letter?

Generally, experience letters are company policies, and employers usually issue them after an employment termination due to misconduct. But if your industry is governed by standing orders, this is a service certificate, and employers are reminded to consult the law before they refuse that service certificate at separation.

Should these letters mention the reason for leaving or performance issues?

Usually not. Both letters should stay factual and neutral, limited to dates, designation and duties. This helps avoid potential lawsuits should you be challenged over the content.

How soon should HR issue the letters after the last working day?

On your last working day or the day or two after. The Model Standing Orders, 2026 (services sector) enforces a 10-day deadline for service certificate, so set an internal deadline within that window before the last stretch.
