A Tata Consultancy Services (TCS) employee won a case of forced resignation after intervention from the Mumbai Labour Office, as per the Financial Express.
The employee in question submitted his plea to the Mumbai Labour Office last year. He claimed that he had been pressured to resign after working at the company for seven years while he was attending to his father in the ICU. The employee approached the administrative body to contest the company’s denial of gratuity despite having a leave balance.
“Despite having sufficient leave balance, TCS not only pushed him to resign but also denied his gratuity,” the Forum for IT Employees (FITE) tweeted.
The Mumbai Labour Office summoned TCS for the same and has warned the company of unfair labour practices. TCS was ordered to pay the employee full gratuity after 7 years of service.
“The Labour Office / Labour Ministry has full authority to question and challenge any company’s internal policies—layoffs, forced resignations, wrongful terminations, or withheld dues. Come forward. Report issues. Your rights are protected only when you raise your voice,” said FITE.
The case underscores the pressure that IT employees continue to face in India, even during periods of personal emergencies. Many employee welfare groups are using the case to urge employees across the country to raise their voice, ask questions, and fight for their rights.
