APCR Report on TCS Nashik: No Proof of Conversion Conspiracy

The Association for Protection of Civil Rights (APCR) Maharashtra unit released a fact-finding report on the TCS Nashik workplace harassment case, stating that investigators have not established any organised attempt at religious conversion at the facility, and that the allegations remain under active investigation without definitive evidentiary backing at this stage.

The report, released at a press conference in Mumbai on Thursday, April 23, 2026, was based on a field visit conducted on April 4, 2026, along with a review of FIRs, court documents, media reports, and stakeholder interactions. APCR has called for a fair and impartial investigation, respect for due process, and restraint in public and media narratives surrounding the case.

“The issue will be used to prevent Muslims from securing employment at corporate workplaces. It is difficult to believe that someone can be forced to observe roza for 24 hours. The FIRs filed by the police raise multiple doubts, and their role has become questionable,” said Nadeem Khan, National Secretary of APCR, addressing the press.

The fact-finding team also flagged what it described as a widening gap between the formal record and the public discourse around the case, where terms such as “corporate jihad” and “love jihad” have been amplified across television and social media without substantiated proof.

Activist Niranjan Takle, a member of the team, pointed to early misreporting regarding the designation of the arrested employee, Nida Khan, who was initially described as an “HR head” but was later clarified by TCS to be a process associate handling operational HR functions rather than a managerial role. The team has called for narco-analysis tests of all complainants and accused, and has demanded that the investigation be handed to a retired High Court or Supreme Court judge.

The Special Investigation Team set up by Nashik Police is currently scrutinising 78 emails, chat communications, and bank transaction records. As of mid-April, nine FIRs have been registered, and at least seven employees, including team leaders and an Assistant General Manager, have been arrested.

In its public statement, TCS has maintained a zero-tolerance policy against harassment and discrimination, suspended the employees under investigation, and engaged Deloitte and the law firm Trilegal to conduct an internal oversight review. The company has said its initial review of official ethics and POSH channels surfaced no complaints corresponding to the current allegations, a claim the SIT is separately scrutinising. The accuracy of all underlying allegations remains subject to the ongoing investigation.
